St George Aged Care is currently in administration and the facility has recently announced that it will be closing.

The HSU met with the Administrators last week to discuss the next steps of this administration process.

During this time, it’s important to know your rights and entitlements.

Your entitlements will remain largely the same, including:

• Coverage under the Aged Care Award
• Payment for time worked
• Payment towards your superannuation
• Payment of your accrued annual leave, long service leave and accrued days off
• Notice of termination
• Payment of the requisite notice period if applicable
• Redundancy/retrenchment pay if applicable.

Redundancy

Redundancy occurs when an employer either decides they no longer need an employee's job to be done by anyone, or the employer becomes insolvent or bankrupt, and terminates their employment.

The Administrators have indicated that it’s likely that remaining employees will be made redundant. Some members have already received redundancy notices.

Your redundancy entitlements are dictated by the National Employment Standards.

Please be advised that your entitlement to redundancy pay may be affected if you have your employment transferred from St George to another employer, or if you resign.

If you have received correspondence from St George requesting consent for your details to be sent to another employer, please contact the HSU before agreeing to anything.

Payment of Your Entitlements - Fair Entitlements Guarantee (FEG)

The Administrators have also advised that St George Aged Care is likely to go into liquidation within 2-3 weeks, in which case, employees may have access to the Fair Entitlements Guarantee (FEG).

The FEG provides financial assistance for unpaid employee entitlements where there is no other source of funds to pay entitlements to eligible employees retrenched due to liquidation of the employer. The Administrators will inform employees if St George goes into liquidation and how to apply for the Guarantee.
