Towards the end of 2020, HSU members working in Wyong CSSD were advised that CCLHD would need to temporarily relocate part of the CSSD to Gosford Hospital for 5 months due to refurbishments being carried out.
These members believed they were entitled to compensation for excess travel time and fares in accordance with Clause 13 of the Health Employees Conditions of Employment (State) Award.
However, following a meeting with the Director of Workforce, CCLHD advised the HSU they considered the move to Gosford a temporary transfer – and as such, did not believe there was an obligation for the District to pay travelling compensation.
Your Union disagreed and sought the assistance of the Industrial Relations Commission (IRC) to determine the matter.
In excellent news for the members concerned, the IRC has now handed down its decision in favour of the HSU, recommending that CCLHD pay travelling compensation in accordance with the Award. This includes back pay. The employer has agreed to abide by the recommendation.
Affected members in Wyong CSSD are to submit claim forms for all excess travel time and fares on all days of travel when working from Gosford Hospital. Should you have any difficulties or questions, please contact HSU Organiser Matthew Ramsay on [E-Mail not displayed].
This is a great win for HSU members at Wyong and shows what is possible when we stand together and stick to our guns. If you know someone who is not yet an HSU member, tell them to take the plunge today at www.hsu.asn.au/join or call 1300 478 679.
