St Basil’s Randwick: Annual leave and your rights

HSU members at St Basil’s Randwick have recently raised concerns around management unilaterally declaring it would not approve ANY leave requests during a certain period.

It’s important workers know their rights when it comes to requesting and taking annual leave.

Some employers have a block-out period for annual leave, especially during a popular holiday period or some festive days, to maintain staffing levels. Staffing levels are important for staff as well as the residents – but an employer cannot say it will unconditionally disapprove ALL annual leave for a certain period. It is important for an employer to communicate with the employees, ensuring the employees’ entitlements set out in the Fair Work Act 2009. 

In accordance with S. 88(2) of the Act, employers “must not unreasonably refuse to agree to a request by the employee to take paid annual leave”. 

When the employee submits an annual leave request with as much notice as possible, the employer must review the application within an appropriate timeframe and communicate the decision to the employee.
