PAC Ashfield site closure: Know your rights!

Presbyterian Aged Care this week announced it would be transferring ownership of the Ashfield site to BaptistCare, along with the closure of the building for redevelopment.

PAC informed the HSU of the move this week, stating: “PAC staff will remain employed by PAC throughout this transition. As residents are relocated and numbers reduce, the roster will be adjusted accordingly, and redundancies will be offered to permanent staff.”.

“Permanent staff will be paid all accrued statutory entitlements payable on termination. Notice periods as per the Enterprise Agreement will also be observed.”

It’s vital you know your rights throughout this process. HSU members have already contacted their union regarding notice period and retrenchment pay.

All the relevant provision and your entitlements are laid out in your Enterprise Agreement for your entitlements.

Clause 43 Termination states:

If your job is discontinued and you are made redundant, Clause 41 of your EA states: “your employer shall pay, in addition to other payments due to that employee, the following retrenchment pay in respect of the following continuous periods of service.".
