As reported in this morning’s newsletter, the HSU last week submitted your Majority Support Determination (MSD) to the Fair Work Commission (FWC). Today, the Fair Work Commission wrote to the parties and advised that the Majority Support Determination had a majority of signatures, which means that it is valid.

Genesis has indicated that they will oppose the HSU’s application in support of a Majority Support Determination, which means that we will now need to await their submissions regarding the MSD. Once this takes place, the HSU will made submissions in response. Ultimately, the Fair Work Commission will decide whether the employees covered by the MSD were ‘fairly chosen’.
