Know Your Rights: Major Workplace Change at Maybanke Aged Care

As you may know, on 27 July 2021 HSU officials attended the first major workplace change meeting held by The Salvation Army Aged Care introducing a new model of care at Maybanke.
Last week, members at Maybanke contacted HSU Organiser Hyojung Kim to advise employees who were impacted by the change were not notified of or consulted with about the changes made to their roster. After the member meeting on zoom, the HSU formally approached management and urged them to follow the fair and proper procedure in completing consultation with staff.
Maybanke management finally agreed that they will:
- Conduct individual consultation meetings with the employees who are affected by the new roster and their representative (i.e. the HSU) on 21 and 22 September 2021; and
- Discuss the workload/staffing level issue raised on 30 July 2021 at all-staff meeting as part of the consultation process. Your local management will confirm the date with your local Organiser.
According to clause 31.2 (a) of The Salvation Army (NSW) AGED CARE PLUS ENTERPRISE AGREEMENT 2017, your employer “must discuss with the employees affected and their representatives, if any, the introduction of” major workplace change. Please note that cl. 31.4 of the Agreement states your employer’s obligation to facilitate “the consultative team” including “3 employee representatives elected by the employees” and meet twice annually or possibly more frequently.
