HSU members who stood up against Opal’s changes to annual leave accrual, have won a landmark victory in the Fair Work Commission!
A Full Bench decision of the Fair Work Commission has confirmed the correct leave entitlements in the current Opal Aged Care (NSW) Enterprise Agreement 2016.
The decision found that an employee is a shiftworker if “their ordinary roster requires any part of their ordinary hours of work outside the day work span of hours” (which is 6am – 6pm Monday to Friday). A full copy of the decision can be found here.
What does this mean for you
Simply put, if you perform any work outside the hours of 6am – 6pm, Monday to Friday, you qualify as a shiftworker for that roster period.
That means that you should be accruing additional annual leave, up to 1 week per year. Your additional annual leave must be accrued each roster period, as you earn it.
